- Healthcare workers (doctors, nurses, etc.)
- Drivers, logisticians
- All professions where labor legislation and occupational safety require work only in the hired format (for example, factory workers, transport services, etc.)
We do not offer tax evasion schemes or act as an employment agency. All decisions are made within the framework of current legislation. A personalized case assessment and recommendations are available after analyzing your contracts and circumstances.
FAQ
Why is it risky for JDG to work directly with a company in Poland?
WITH Changes are being prepared in Poland in 2026, which will give inspectors of the Państwowej Inspekcji Pracy (PIP) more powers to reclassify civil-law relationships (B2B) into labor relationships (umowa o pracę).
With the introduction of the KSeF (Krajowy System e-Faktur) system, all your invoices will be under the full control of government agencies—the Tax Office, ZUS, and PIP. They will be able to see all transactions between Polish companies and the JDG in real time.
This means that if JDG actually works as a full-time employee (fixed schedule, regular monthly payments, identical duties, constant subordination, no entrepreneurial risk), then even with the presence of invoices and a B2B contract, the inspectorate will be able to recognize such a relationship as an employment relationship.
Consequences for the company:
— the need to pay additional taxes and ZUS contributions for the entire period of cooperation,
— fines for circumventing labor laws,
— possible criminal liability of the company's director.
Can JDG work with a Polish B2B company without the risk of being reclassified as an employment relationship?
Yes, it can—if the collaboration is truly entrepreneurial in nature, not labor-based. To avoid being reclassified as a work-related contract, it's important:
— work on the basis of a contract for the provision of services (umowa o świadczenie usług);
- have freedom to organize work (no fixed schedule, no supervision, ability to refuse assignments);
- use your tools and methods;
— bear entrepreneurial risk (for example, work with several clients, do not depend economically on one customer in Poland).
We solve this problem once and for all – by creating a legal cooperation structure and formalizing all contracts so that the relationship between JDG and the Polish company remains legally secure and transparent.
Do you need to have other clients?
This isn't a mandatory requirement, but having at least two clients reduces the risk of the relationship being considered an employment relationship. For tax and labor authorities, this is one of the indicators of the entrepreneur's independence, so we recommend reflecting at least occasional collaboration with other clients in contracts and reports.
How can I pay Polish JDG without VAT if my company is in Poland?
If both parties are registered in Poland, the transaction is subject to VAT at the applicable rate for the type of service (usually 23%). VAT 0% only applies when services are exported abroad, meaning when the recipient is located outside of Poland. However, a JDG may be exempt from VAT (tax exempt) for turnover of up to PLN 200,000 per year. In this case, it issues an invoice exempt from VAT with the note "exempt from VAT on podstawie art. 113 ust. 1 ustawy o VAT.".
We organize our work so that JDG remains VAT-exempt even if the limit is exceeded. This allows companies in Poland to securely pay JDG for services without VAT accrual and without the risk of tax consequences.
What is required to transfer copyright?
The contract must explicitly state that the contractor (JDG) will transfer the copyright to the client upon payment. The following must be specified:
— the subject of transmission (what exactly is created and transmitted);
— the moment of transfer of rights (usually after acceptance and payment for the work);
— the possibility of further use of the result by the customer.
We include such provisions in our templates to ensure that the client receives full rights to the results and the contractor receives legal protection.
What documents are required to cooperate with us and JDG?
For cooperation in Poland:
- properly executed B2B contracts,
- certificates of completed work,
— documents on the transfer of copyright to the end customer.
We prepare and process all of these documents ourselves to ensure that cooperation between the company and JDG is completely legal, secure, and compliant with Polish law.
To start cooperation, it is enough:
— B2B agreement between our company and the client.
— A copy of the passport and the CEIDG JDG extract.
— For international payments — VAT UE certificate (if JDG is registered as VAT-UE).
